A freehold Bangkok site has reportedly sold for a very large sum. This article sets out what that news says, and what a foreign buyer can actually own, pay and prove.
Thaiger reported on 6 October 2026 that two Thai property groups bought the former Dutch embassy site on Wireless Road for more than 20 billion baht. The site is freehold. A foreign buyer can own a condo unit freehold, within a 49% foreign quota, but cannot own land.
It tells a foreign buyer about two Thai groups and one freehold site, and nothing about foreign rights. Thaiger reports the land at about 7,926 square wah, reachable from Wireless Road and Soi Ton Son. It says the price works out at roughly 2.52 million baht per square wah, while valuers had put the market rate at 2.8 to 3.5 million baht before the sale was reported. Thaiger describes the sale as reported, not confirmed.
| Item | Thaiger report | Thaiger Legal rule for foreigners |
|---|---|---|
| Buyer | Two Thai property groups | Foreigners cannot own land |
| Title type | Freehold land | Condo unit freehold within 49% quota |
| Headline price | More than 20 billion baht | 2% transfer fee for foreign buyers |
It gives you freehold ownership in your own name, provided foreigners hold no more than 49% of the building's saleable floor area. Thaiger Legal cites section 19 of the Condominium Act B.E. 2522 (1979) for this. The quota is per building, and Thaiger Legal notes that popular buildings fill theirs. Its advice is to get written quota confirmation from the juristic person office before paying any deposit. A Bangkok land deal between Thai groups does not alter that check for a unit you are considering.
You hold rights over someone else's land, not the land. Thaiger Legal lists a registered lease of 30 years maximum, a usufruct (use for life, ending at your death) or a superficies (you own the building, and it is inheritable). It also reports a March 2025 Supreme Court ruling that pre-agreed automatic renewal clauses are void. Renewal takes a fresh registration, if the landowner still agrees. So treat 30 years as the real term, and read any renewal promise in a brochure with that in mind.
It stops at what the two sources say. Thaiger's item does not state who the sellers or buyers act for beyond the two groups, what they plan to build, or whether the price was paid in full. Neither source links this sale to condo or villa prices elsewhere, so no such link should be assumed. Thaiger Legal's rules concern foreign buyers; a purchase of land by two Thai groups falls outside them. A nominee Thai company is not a workaround: Thaiger Legal calls it illegal, with Foreign Business Act penalties of up to three years in prison and fines up to 1,000,000 THB.
Do three things, per Thaiger Legal: confirm the quota in writing, send the funds correctly, and have the contract and title read by someone acting only for you. The funds must arrive in foreign currency, in your own name, with the purpose stated. Keep the FET form (issued at US$50,000 and above) or the bank letter below that; you need it again to send sale proceeds out.
| Step | What to obtain | Why |
|---|---|---|
| Quota | Written confirmation from the juristic person | 49% foreign limit per building |
| Funds | FET form or bank confirmation letter | Land Office registration; later repatriation |
| Fees | Contract fixing the 2% transfer fee split | Split is negotiated; foreigners pay full 2% |
| Legal review | Contract and title read by your own adviser | Before signing, not after |
Hush Villas offers four turnkey private-pool villas on Koh Phangan from $135,000, handover Q1 2027. What is registered and guaranteed at signing is the 30-year lease; later terms depend on agreement at renewal, and the lease passes to the buyer's heirs on its existing terms.

Nothing in Thaiger's report or Thaiger Legal's guide says so. Foreigners still cannot own land and may own condo units within the 49% quota.
Thaiger Legal says 2% of appraised value, split by negotiation. The 0.01% stimulus rate applies only to Thai natural persons on property up to 7,000,000 THB.
Thaiger Legal warns that baht borrowed inside Thailand is not foreign currency remitted from abroad, so section 19 evidence must still come from overseas funds.
Thaiger Legal cites 3.3% specific business tax on sales within five years, or 0.5% stamp duty otherwise, never both, with listed exemptions.
